JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 24-04-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.

There happens to be an allegation against petitioner Heera Sah to have inflicted iron rod blow over head of informant while Kailash Sah inflicted knife blow. On hue and cry raised by him, his son Sanjeev Sah rushed in rescue, who was assaulted by the petitioner Pramila Sah. Furthermore, an allegation has been attributed against Heera Sah to have taken away Rs.5,000/-. Injury report of respective injured speaks presence of simple injury on both the injured. Taking away Rs.5,000/- from the cash box, appears to be improbable in the background of establishment of the shop.

Accordingly, petitioners are directed to surrender

Patna High Court Cr.Misc. No.5888 of 2015 (04) dt.24-04-2015 before the learned lower Court with a prayer for bail which, the learned lower Court will consider in light of finding so recorded hereinabove.

With the aforesaid observation, instant petition is disposed of.
