The petitioners are languishing in custody in a case registered for the offences punishable under Sections 457, 380 of the Indian Penal Code.

It is a case of commission of robbery from the flat of the informant and taking away cash, jewelries and other valuable articles by unknown miscreants. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R and his name subsequently sprang up on the confessional statement of co-accused Raja Khan @ Taiyab Khan. Nothing has been recovered

Patna High Court CR. MISC. No.17131 of 2023(4) dt.21-06-2023 2/2 from the conscious possession of the petitioner. The T.I.P has still not been held. Similarly situated other accused persons have already been enlarged on bail by this Bench of this Court vide order dated 12.5.2023 passed in Cr. Misc. No. 18457 of 2023. The petitioner is languishing in custody since 11.11.2022. Learned APP appearing for the State has opposed the prayer of Bail.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna in connection with Shastri Nagar P.S. Case No. 743 of 2022.
