Patna High Court CR. MISC. No.16008 of 2020(2) dt.15-07-2020 2/3 Petitioners apprehend their arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Prosecution's case in short is that because of a dispute for cutting & lifting bamboo, the petitioners and other accused persons abused the informant. They assaulted the father of the informant and caused fracture injury in his jaw. They also assaulted the mother and uncle of the informant. Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case. Parties are Gotia and there is admitted land dispute. Proceedings under section 144 Cr.P.C. had also been initiated between them. Petitioner no.1 has also filed Shankarpur Police Station Case No. 10/2019 against the informant and his family members. Petitioners have got no criminal antecedent.

Considering the facts of the case, let the petitioners named above, in the event of surrender before the Court below be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Madhepura in Shankarpur Police Station Case No. 09/2019, subject to the conditions laid down under sections 438 of the

Patna High Court CR. MISC. No.16008 of 2020(2) dt.15-07-2020 3/3 Code of Criminal Procedure.
