The petitioner apprehends his arrest in Sherghati P.S. Case No. 21/16, registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Section 25(1b)a/26/35 of the Arms Act and Section 17 C.L.A. Act. On secret information the police apprehended four persons while they were going for committing offence and apprehended accused persons said to have disclosed the name of the petitioner.

It is submitted that save and except the fact that the name of the petitioner was disclosed by the apprehended accused persons, there is no material to show his involvement. Out of the apprehended accused persons Kapil Yadav had already been

Patna High Court Cr.Misc. No.16367 of 2016 (2) dt.09-05-2016 2/2 granted regular bail vide order dated 22.04.2016 passed in Cr. Misc. 16178/2016.

Considering the facts aforesaid and the fact that name of the petitioner is figured by the apprehended accused persons and they are being arrested, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. If the petitioner surrender before the court below the learned court below shall consider his prayer for regular bail taking into consideration that apprehended accused persons have already been granted bail and dispose of the bail petition on the same day.
