The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 323, 379, 387, 380, 341, 147, 148, 149 and 504 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, the five named accused persons are said to have come variously armed and made a demand of Rs.5 Lacs from the informant. On the informant making an attempt to make a phone call, it is stated that one of the accused shot at the informant injuring him on the right side of his chest. Others also fired at him.

It is submitted by learned counsel for the petitioner

No. 16335 of 2022(4) dt.06-01-2023 2/2 that inspite of the detailed narration of the occurrence in the F.I.R along with name of all the five accused persons who participated in the occurrence, the petitioner has not been named in F.I.R. The name of the petitioner transpired in course of investigation in the confessional statement of a co-accused Raju Kumar who has himself been enlarged on bail. The petitioner is in custody since 7.1.2022 and charge-sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the material that has transpired against the petitioner in course of investigation and the petitioner having remained in custody since 7.1.2022 and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Bakhtiyarpur P.S. Case no. 8 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Barh, Patna.
