2. The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 29 of 2024 registered for offences under Sections 85, 89, 115(2), 126(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. Petitioner is the husband of the victim. It is alleged that all the accused persons including the petitioner have brutally assaulted the victim/informant.

4. Learned counsel for the petitioner submits that petitioner is quite innocent and has not committed any offence. He further submits that the specific allegation is against the mother-in-law. Petitioner claims clean antecedent.

5. Learned APP for the State has vehemently opposed

6. Considering the facts and circumstances of the case, this application for anticipatory bail is allowed.

7. Accordingly, let the petitioner, above-named, in the event of his arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari/concerned Court below in connection with Mahila P.S. Case No. 29 of 2024 subject to the conditions as laid down under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 and with a further condition that:- i). Before accepting the bail-bonds of the petitioner, the Court below will verify the antecedent of the petitioner. If the petitioner is found having clean antecedent, then the bail-bonds of the petitioner shall be accepted. If the petitioner is found having criminal antecedent(s), then his bailbonds shall not be accepted by the court below.
