JUSTICE SUDHIR SINGH ORAL ORDER 16-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending her arrest in connection with Amarpur P.S. Case No.212 of 2010 for the offences instituted under Sections 302, 201 and 34 of the Indian Penal Code.

The prosecution case, in brief, is that there was strained relationship between the deceased Aruna Devi and her husband Yogendra Das, the petitioner. The informant is their daughter. The elder brother of the informant, namely, Sittu Das was earning his livelihood outside the house and his wife Savita Devi was living in the house with her father-in-law Yogendra Das.

The informant was getting treatment of her mother at village Athmaha. His father called his mother and when his mother went to her husband, Yogendra Das, with the help of others committed murder of Aruna Devi and threw the dead body in Bahiyar. It is submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Petitioner has falsely been implicated in the present case. Petitioner happens to be the daughter-in-law of the deceased. The husband of the deceased wanted to transfer the property in favour of the petitioner hence the informant has falsely implicated the petitioner in the present case. Petitioner is a lady. Other co-accused have been granted anticipatory bail vide Cr. Misc. No.19119 of 2014. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka, in connection with Amarpur P.S. Case
