Petitioner is languishing in judicial custody since 31.01.2018 in connection with Excise Case No. 50 of 2018 arising out of P.R. No. 86 of 2018 for offences punishable under Section 30A of the Bihar Prohibition and Excise Act, 2016. The prosecution case, as lodged by the Excise Officials, is that near Kirana shop in a straw room, 12 liters of Nepali Saufi wine was recovered. Accordingly, a seizure list was prepared. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and nothing has been recovered from his conscious possession. However, learned APP for the State opposes the prayer

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV-cum-Special Judge, Excise, East Champaran at Motihari in connection with Excise Case No. 50 of 2018 arising out of P.R. No. 86 of 2018, subject to the condition that petitioner will co-operate in the investigation and provide all papers necessary during investigation and will not tamper with the evidence failing which, his bail bonds will be cancelled.
