JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 386/34 of the Indian Penal Code.
Prosecution case is as per the informant being administrative Manager of Infrastructure Company constructing National Highways to the effect that the petitioner demanded extortion and resorted to fire. It is also alleged that earlier also the petitioner gave life threatening when Ara Nawada P.S. Case No.469/2015 has been lodged against the petitioner and his two brothers.
Learned counsel for the petitioner submits that earlier Ara Nawada P.S. Case No.469/2015 was lodged by the informant with regard to a dispute for giving the land of the petitioner's side
Patna High Court Cr.Misc. No.14902 of 2016 (2) dt.08-04-2016 2/3 on lease to the construction company of the informant wherein in connivance with the police the petitioner was arrested and on being released the police officer, who was in connived with the informant, was immediately trapped while accepting illegal gratification, leading to registration of Vigilance Case No.11/2016. Hence, the police officer again set up the informant to rope the petitioner in the present case. Moreover, firing alleged to have caused injury to none. Even assuming the accusation, no offence under section 386 IPC is made out and wife of the petitioner has lodged Ara Nawada P.S. Case No.474/2015 levelling accusation under sections 323, 341, 354, 506/34 of the Indian Penal Code against the informant and two other persons. It is further submitted that prior to lodging of Ara Nawada P.S. Case No.469/2015 lodged by the informant's side, the petitioner has no criminal antecedent.
Considering the accusation being levelled in the background of litigated relationship between the parties, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bhojpur at Ara in
