2. The petitioner is apprehending his arrest in connection with Kotwali (Munger) P.S. Case No. 176 of 2024 registered for the offences punishable under Sections 341, 323, 354, 307, 504, 506/34 of the Indian Penal Code.
3. Learned Advocate for the petitioner fairly contended that earlier the petitioner approached this Court for grant of anticipatory bail in Cr. Misc. No. 71265 of 2024, however, taking note of the nature of the injury and the criminal antecedent of the petitioner, his prayer for grant of anticipatory bail came to be rejected vide order dated 23.10.2024.
4. Learned Advocate for the petitioner contended that in fact while considering the prayer for anticipatory bail on the last occasion, this fact has not been taken into consideration that

No.16185 of 2025(3) dt.13-05-2025 2/3 the petitioner has been suffering from heart disease and he is under regular treatment of doctors and completely dependent upon the family members for his treatment. Moreover, there was a case and counter case and various other facts, which could not be taken into consideration.

On the other hand, learned APP for the State while opposing the prayer for grant of anticipatory bail has contended that there is no doubt that the second successive anticipatory bail application of an accused can be entertained, but in substantive changed circumstance and there is no changed circumstance, which requires reconsideration. It is also submitted that this fact cannot be ignored that this petitioner is carrying seven criminal antecedent on his head.
6. Considering the fact that the prayer for anticipatory bail of the petitioner has already been turned down after considering the submissions of the petitioner vide order dated 23.10.2024 in Cr. Misc. No. 71265 of 2024, and there is no substantive change in the circumstance, which requires fresh consideration. The prayer for grant of anticipatory bail of the petitioner stands negated and accordingly, the present bail application is hereby rejected.
7. The petitioner is directed to surrender before the
Patna High Court CR. MISC. No.16185 of 2025(3) dt.13-05-2025 3/3 court below preferably within a period of four weeks from today. In case, the petitioner surrenders before the court below and prays for regular bail, the court below shall consider the prayer for bail of the petitioner without being prejudiced by the order of this Court.
