ANJANA MISHRA ORAL ORDER 23-07-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Kuchaikot P.S. Case No.150 of 2013 for allegedly having committed the offences under Sections 420, 406 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation of having cheated the money of the informant and other members of the village is against Geeta Pathak alias Mataji and her husband Hulashi Pathak of Village-Tadwa Manakpur, P.S.- Mathura. Learned counsel for the petitioner submits that only allegation against the petitioner is that he had come along with the said persons to the shop of the informant and introduced them to him, as a result of which the money was

Patna High Court Cr.Misc. No.20106 of 2015 (2) dt.23-07-2015 2/2 given for the purpose of Yagya. Save and except the said allegation, there is no other act of the petitioner so as to bring him into the offence of defrauding the informant. Considering the aforementioned submissions and the fact that that the petitioner has no other role to play and has no criminal antecedents, let the above named petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Kuchaikot P.S. Case No.150 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
