The petitioners, three in number, apprehend their arrest in Bihta P.S. Case No. 519/2014 registered under Section 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act.

The petitioners are alleged to have assaulted the informant and his relatives. Learned counsel for the petitioners submits that the petitioners are innocent and on account of previous enmity the petitioners have falsely been implicated in the case.

It appears that the prayer for anticipatory bail of similarly situated accused persons Shiv Kumar Mahto and others has already been disposed of vide order dated 12.10.2015 passed

Patna High Court Cr.Misc. No.14448 of 2016 (5) dt.13-07-2016 2/2 in Cr. Misc. No. 40433/2015.

Considering the facts aforesaid, this Anticipatory Bail Petition is disposed of with a direction to petitioners to surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order and make a prayer for regular bail in Bihta P.S. Case No. 519/2014. The learned court below shall consider the bail petition of the petitioner without being prejudiced from this order. (Prabhat Kumar Jha, J) Dilip/- U T
