JUSTICE ARUN KUMAR ORAL ORDER 24-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 6.9.2017, seeks bail in Athamalgola PS Case No. 219 of 2017 registered under Sections 302, 120B/34 of the IPC and Section 27 of the Arms Act. The allegation in brief is that the petitioner, who was accused in the case of murder of informant's son conspired with others accused persons for killing husband of the informant as he did not yield to the pressure not to depose and the specific allegation of killing the informant's husband is against Santosh Kumar and Subham.

Learned Counsel for the petitioner submits that the petitioner at the relevant point of time was in custody and he is said to have conspired but in the case of the informant's son he has been acquitted by the sessions court and has been remanded in this case since 6.9.2017 and since then he is in custody. Having considered the said facts and circumstances, the petitioner, namely, Golu Singh @ Golu Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Barh, Patna in connection with Athamalgola PS Case No. 219 of 2017.
