JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-01-2021 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State assisted by learned counsel for the complainant.

Petitioners apprehend their arrest in connection with Jalalgarh P.S. Case No. 03 of 2020 registered for the offences punishable under Sections 120B, 420,467 and 468 of the Indian Penal Code.

The accusation against the petitioners as well as other accused is that they fraudulently got executed sale deed in respect of lands of informant's husband.

Learned counsel appearing for the petitioners submits that petitioners and informant are members of same

Patna High Court CR. MISC. No.20130 of 2020(5) dt.11-01-2021 2/2 family and as a matter of fact, there is land dispute between them. He further submits that the facts of the present case constitute civil dispute and, moreover, having more or less, similar allegation co-accused Shahnaz Begum, Sohrab Ansari, Muslim Ansari had already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 15.07.2020 passed in Cr. Misc No. 18620 of 2020.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub- Divisional Judicial Magistrate, Purena in Jalalgarh P.S. Case No. 03 of 2020 subject to condition as laid down under Section 438(2) of the Cr.P.C.
