This application is for grant of regular bail in connection with Kishanganj P.S.Case No.113 of 2017 for the offences punishable under Sections 341, 323, 504, 307 and 34 of the Indian Penal Code.
Allegation against the petitioner is of assault to the informant causing injury to him.
Submission of the learned counsel for the petitioner is that there are case and counter case between the parties and there is no repetition of blow. The petitioner is in custody since 2.8.2017.
Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail on the ground
Patna High Court Cr.Misc. No.49685 of 2017 (3) dt.09-11-2017 2/2 that the injury was grievous in nature.
Having heard both sides and in view of facts and circumstances, at this stage, I am not inclined to grant bail to the petitioner. As such this application is disposed of with direction to the learned trial court that once the charge is framed against the petitioner, he shall release the petitioner in connection with Kishanganj P.S.Case No.113 of 2017 to his own satisfaction. With the aforesaid observation, this application is disposed of.
