JUSTICE ARUN KUMAR ORAL ORDER 24-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 16.10.2017, seeks bail in GRP Bakhtiarpur PS Case No. 204 of 2017 registered under Sections 341, 323, 324, 307, 353, 399, 402, 34 of the IPC and Sections 25(1)(b), 26, 35 of the Arms Act.

The allegation in brief is that five persons were apprehended by the police near railway platform for committing dacoity in a running train.

Learned Counsel for the petitioner submits that only two hundred twenty rupees cash was recovered from the possession of the petitioner, no incriminating material has been recovered from his possession, he has clean antecedent, Kamlesh Kumar and Santosh another co-accused from whose possession knives were recovered they too were granted bail by a coordinate Bench of this Court, the case of the petitioner stands on better footing to that of Kamlesh and Santosh.

Having considered the said facts and circumstances, the petitioner, namely, Rabin Kumar Paswan @ Rabin Paswan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten

Patna High Court Cr.Misc. No.24445 of 2018 (2) dt.24-04-2018 thousand) with two sureties of the like amount each to the satisfaction of ACJM Railway, Patna in connection with GRP Bakhtiarpur PS Case No. 204 of 2017.
