JUSTICE ASHUTOSH KUMAR ORAL ORDER 236 13-03-2019 The petitioner seeks modification of the order dated 19.12.2018 passed in Cr. Misc. No. 69336 of 2018 to the extent of granting/extending further time for surrendering before the Court below for grant of bail. It has been stated in the application seeking extention of time that because of medical problem, the petitioner could not surrender within four weeks of the passing of the order dated 19.12.2018, necessitating the filing of the present application for extension of the aforesaid time.
Perused the grounds urged in the petition.
This Court is satisfied that the petitioner was
Patna High Court CR. MISC. No.13978 of 2019(236) dt.13-03-2019 2/2 precluded from surrendering before the Court below on time because of the reason which was beyond her control. Taking into account the aforesaid facts, the order dated 19.12.2018 passed in Cr. Misc. No. 69336 of 2018 is modified to the extent that on the petitioner surrendering before the Court below within a period of four weeks from today, she shall be released on bail on her furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Munger/concerned Court in connection with Kharagpur P.S. Case No. 41 of 2016. The order dated 19.12.2018 passed in Cr. Misc. No. 69336 of 2018 is modified accordingly.
