This is an application for bail in connection with Agion Bazar P.S. Case No. 6 of 2017 registered for the offences punishable under Sections 376-D and 323 of the Indian Penal Code.

Allegation against the petitioner and one co-accused is of committing forcibly rape upon the informant.

Submission of learned counsel for the petitioner is that the manner of occurrence is improbable and there is delay of four days in lodging of FIR. Further submission is that even she has not been examined medically and he is in custody since 16.2.2017. Heard learned APP also, who has opposed the prayer for bail on the ground that the victim girl has supported the allegation

Patna High Court Cr.Misc. No.39080 of 2017 (3) dt.14-09-2017 2/2 in her statement under Section 164 Cr.P.C.

Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody, learned trial court is directed to expedite the trial of the petitioner. With the above observation, this application is dismissed.
