JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-07-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 7 of the EC Act. As per the prosecution case, on physical verification of PDS shop of the petitioner, shortage of 406.35 quintals of food grain, was detected by the authorities. Learned counsel appearing for the petitioner while denying the allegation submits that the PDS licence has already been suspended. Enquiry was made on 26.8.2022 and FIR was lodged on 8.9.2022 and there is no explanation of delay. Petitioner is PDS dealer since 16.5.2016 and there is no complain of beneficiaries till date. Petitioner claims clean antecedent.
Considering the aforesaid facts of the case, prayer for
Patna High Court CR. MISC. No.16488 of 2023(3) dt.03-07-2023 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I, Madhubani in Harlakhi Police Station Case No. 276 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
