JUSTICE MADHURESH PRASAD ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offence under sections 302/34 of the IPC and under section 27 of the Arms Act.
The informant, brother of the deceased, alleged that on hearing of his brother being shot, he reached the place of occurrence and brought him to the hospital for treatment. On the way to the hospital, he disclosed the name of nine persons as the assailants. During investigation, one Md. Guran was also implicated in this case and on the basis of his confessional statement, the petitioner has been implicated in this case. Learned counsel for the petitioner submits that though there are some other cases against the petitioner, but in all the cases he is on bail. He submits that the petitioner has been implicated in this case due to village politics and except the
Patna High Court Cr.Misc. No.39237 of 2017 (2) dt.19-08-2017 confessional statement of said co-accused, there is nothing against him. Other co-accused, namely, Anant Kumar Mishra @Bhagwan Jha and Bhudeo @ Chandwa @ Sahabuddin have already been allowed bail by different benches of this Court vide orders dated 20.6.2017 and 6.7.2017, passed in Cr.Misc.Nos. 18912 and 30612 of 2017. Investigation of the case has been completed and charge sheet has also been filed in the case. Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VI, Purnea in Banmankhi Police station Case No. 18 of 2017.
