====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 04-05-2018 Heard Sri Nilesh Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 10.04.2017 in Baligaun P.S. Case No.13 of 2017 registered for the offence under Sections 461/379/34 of the Indian Penal Code, has prayed for grant of bail At the very outset, learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to village politics. He submits that at the time of occurrence, while accused persons were fleeing away with Galla ( wooden box) of the informant, the petitioner from the mob was apprehended as if the petitioner was also one of the associates. He further submits that the petitioner has already remained in custody for more than one year. It was informed by

Patna High Court Cr.Misc. No.26975 of 2018(2) dt.04-05-2018 2/2 learned counsel for the petitioner that in the case , charge has already been framed, however till date the prosecution has not produced any witness.

Considering the nature of accusation and period of custody , let the petitioner, namely, Mangalam Kumar Golu @ Mangalam Kumar @ Golu be released on bail on furnishing bail bond of Rs.10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate 12th , Vaishali at Hajipur in connection with Baligaun P.S Case No.13 of 2017 with conditions that (i) one of the bailors must be blood relation of the petitioner and (ii) during trial, on each and every date, the petitioner shall remain physically present in the court below. If continuously on two dates, the petitioner remains absent without prior permission of the trial court, his bail bond shall stand automatically cancelled. (Rakesh Kumar, J) nawalkrs/- U T
