ANJANA MISHRA ORAL ORDER 30-07-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in connection with Sheo Sagar (Baddi O.P.) P.S. Case No.325 of 2014 for allegedly having committed the offences under Sections 147, 148, 149, 323, 324, 341, 504, 506, 307 and 379 of the Indian Penal Code.
Learned counsel for the petitioners submits that the nature of allegations clearly reveals that the petitioners and others had come together on account of some disputes. Learned counsel for the petitioners further submits that an altercation took place and as a result thereof, one Sudarshan Paswan had also filed a case
Patna High Court Cr.Misc. No.20294 of 2015 (2) dt.30-07-2015 2/2 in which these petitioners have been named as those persons who came to save said Sudarshan Paswan. The said case has also been registered as Sheo Sagar P.S. Case No.324 of 2014 dated 31.12.2014 whereas the present case is registered as Sheo Sagar P.S. Case No.325 of 2014. It is submitted that both the parties had received injuries on account of the said altercation, but the injuries are simple in nature.
Considering the nature of allegations and the fact that there is case and counter case between the parties, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sasaram, Rohtas, in connection with Sheo Sagar (Baddi O.P.) P.S. Case No.325 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
