This application for regular bail arises out of Barharia P.S. Case No. 149 of 2019, disclosing offence under Sections 147,148,149,341,323,307 and 302 of the Indian Penal Code. On perusal of the First Information Report, it appears that a trivial dispute arising out of taking water from hand pump between the informant's husband and others led to certain altercation and thereafter scuffle. There is allegation of assault against the persons named in the First Information Report leading to grievous injury, which the informant's husband sustained. Subsequently, he succumbed to the injury. Learned counsel appearing on behalf of the petitioner appears to be correct in his submission that the main allegation
Patna High Court CR. MISC. No.12973 of 2020(2) dt.03-03-2020 2/2 of assault is against co-accused Rama Shankar Ram and there is no specific allegation of assault against this petitioner. Two other co-accused persons, namely, Ramashish Ram and Ragho Singh have been allowed regular bail by this Court by orders dated 13.09.2019 passed in Cr. Misc. No. 44886 of 2019 and 30.08.2019 passed in Cr. Misc. No. 65559 of 2019, respectively. Considering the above submission, in my view, a case for grant of regular bail is made out. This application is allowed. Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in Barharia P.S. Case No. 149 of 2019.
