Case No. 335 of 2019, regarding no. 178 of 2020 dated 08.10.2019 instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It appears from the records that from the house of the petitioner, 406 litres of foreign liquor and 40.6 litres of beer was recovered .

It has been submitted that apart from the present case, the petitioner has been made accused in only one case so far.The case, it has been argued, has been

Patna High Court CR. MISC. No.16399 of 2020(3) dt.13-05-2020 2/2 lodged against the brother of the petitioner but the name of the petitioner has transpired only during the course of the investigation.

The petitioner is stated to be in custody since 21.01.2020.

Considering the afore-stated facts as also taking into account that the petitioner is separate in mess and business from his brother, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, 2nd cum Special Judge, Katihar in connection with C.I. Case No. 335 of 2019, regarding no. 178 of 2020.
