The petitioner has preferred this application for grant of regular bail in a case registered under section 366A of the Indian Penal Code and section 4 of the POCSO Act. As per the prosecution case, the 13 year old victim grand daughter of the informant in her statement under section 164 Cr.P.C has made allegations against this petitioner of having committed rape on her.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case and is in custody since 17.11.2018.

As per the report received from the learned Court below contained in letter dated 6.8.2021, one out of the three

Patna High Court CR. MISC. No.25503 of 2021(3) dt.25-08-2021 2/2 prosecution witnesses have been examined.

In view of the facts of the case, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.

Learned trial Court is directed to expedite the trial and to conclude the same preferably within a period of six months from the date of communication of this order. (Partha Sarthy, J) Prakash/- U
