The petitioners, namely, Kara Yadav, Ranjeet Yadav, Basudeo Yadav and Umesh Yadav, apprehend their arrest in a case under Sections 341, 323, 307, 504/34 of the Indian Penal Code.
The informant alleged that while he was cutting grass the petitioners with whom there had been a dispute with regard to pathway came and assaulted the informant with iron rod and pistol. It is submitted that there is a counter-version and, on account of harvesting of mustard crops, some altercation took place. The injuries found on the person of the informant are simple in nature.
Patna High Court Cr.Misc. No.16972 of 2016 (2) dt.13-05-2016 2/2 Learned counsel for the informant as well as learned A.P.P. has vehemently opposed the prayer for anticipatory bail. Considering the facts that there is a case and countercase and the injuries sustained by the informant is simple in nature, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda in Bind P.S. Case No. 106/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
