The petitioners seek bail in a case registered for offences under Sections 30 (A) and 56(B) of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 360 bottles each containing 750 ml and 426 bottles each containing 375 ml, i.e., total 439 litres of foreign liquor were recovered from the Scorpio which was being boarded by four persons including the petitioners who were caught on chase by the police when they tried to escape. Patna High Court Cr.Misc. No.39150 of 2017(2) dt.19-08-2017 2/2 antecedent and are in custody since 16.06.2017. Considering the facts and the circumstances of the case, the petitioners, above named are directed to be released on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IV, Bhojpur at Ara in connection with Behia P.S. Case No. 192 of 2017 (Excise case No. 1914 of 2017) with a condition that one of the bailors will be the resident of Bihar since the petitioners belong to Haryana. Further, if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
