The petitioners seek bail in a case instituted for the offences under Sections 399, 402 of the I.P.C. as well as Sections 25(1-b)a, 26, 35 of the Arms Act and Sections 47/53 of the Bihar Prohibition and Excise Act, 2016.

Allegation is that 750 ml of foreign liquor is recovered. It has been submitted on behalf of the petitioners that the petitioners are in custody since 22.12.2016 and charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioners. No offence under the Arms Act is made out against the petitioners. It is alleged that 750 ml of foreign liquor is said to have been recovered.

Patna High Court Cr.Misc. No.49478 of 2017(3) dt.17-10-2017 2/2 There is no compliance of Section 100 Cr.P.C. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 6th Additional District and Sessions Judge-cum-Special Judge (Excise), Nalanda at Biharsharif in connection with Manpur P.S. case No.119 of 2016.
