Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Bettiah Town (Kalibagh) P.S. Case No. 949 of 2022 dated 19.12.2022 registered for the offences punishable under Sections 272/273 of IPC and Section 30(a) of Bihar Prohibition and Excise Act. 3.
The main submissions advanced by learned counsel for petitioner are that the instant matter relates to the recovery of 22.5 litres of country made illicit liquor and the same is alleged to have been recovered from the house of this petitioner, infact the said house is in joint possession of the family members of this petitioner and the recovered liquor was not found in the conscious possession of this petitioner, though against the petitioner there are criminal antecedent of three cases but he has
Patna High Court CR. MISC. No.15036 of 2023(2) dt.08-05-2023 2/2 got bail in all the said cases and has been languishing in jail since 20.12.2022 and against him the investigation has been completed.

Learned APP for the State opposes the bail prayer of the petitioner.

Considering the above submissions and mainly the petitioner's custody period and the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail, after framing of charge, if the same has not been framed, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Bettiah Town (Kalibagh) P.S. Case No. 949 of 2022.
