BADAR ORAL ORDER 08-12-2021 The applicant/accused in Crime No. 280 of 2020 with Motipur police station for the offence under sections 364(A) of the Indian Penal Code, by this application is seeking is release on bail during pendency of the trial.

Heard the learned counsel for the applicant at sufficient length of time. He argued that the applicant is father of co-accused Sunil Sahni and therefore, he is falsely implicated in the crime in question. It is further argued that the kidnapped child is now recovered and on the basis of confession of the coaccused, the applicant is arrested. It is further argued that no role is attributed to the applicant even by co-accused Nilam Devi. The learned APP opposed the application by contending that the offence is serious and the accused persons had formed an organized gang for kidnapping the child for

I have considered the submission so advanced and also perused the case diary.

Shatrughan Ram, the informant had reported in his FIR that his six years old son Krishna Mohan Kumar is kidnapped from 6.11.2020 for ransom of Rs 4 lakhs. He has mentioned about a telephonic call from a particular mobile number for demand of ransom for returning the kidnapped child. During the course of investigation, the kidnapped child of six years of age came to be recovered from co-accused Nilam Devi. The applicant came to be apprehended subsequently along with his cell phone. The applicant was also the part of the organized gang who had kidnapped the victim child for a ransom of Rs. 4 lakhs.

Considering the nature of offence, no case for grant of bail is made out. The application is therefore, rejected. (A. M. Badar, J) Ravi/- U T
