ANJANA MISHRA ORAL ORDER 20-09-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is in custody since 23.04.2017 in connection with a case registered for the offences punishable under Section 395/412 of the Indian Penal Code. Learned counsel for the petitioner submits that though he is not named in the First Information Report, his name surfaced on the basis of confessional statement made by the coaccused, namely, Ankesh Kumar who has since been extended the privilege of regular bail. It is submitted that though there were recovery from the house of the petitioner, the articles so recovered were not placed for T.I. Parade and, therefore, the petitioner cannot be prosecuted.

No.41442 of 2017 (2) dt.20-09-2017 2/2 Having heard learned counsel for the petitioner and learned counsel appearing on behalf of the State, it appears that the petitioner's case also stand on similar footing to the coaccused Ankesh Kumar. Taking into consideration all facts and circumstances of the case and the co-accused has already been granted bail, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Dalsinghsarai, Samastipur in connection with Dalsinghsarai P.S. Case No. 92 of 2017.
