The instant civil misc. petition has been filed by the petitioner with prayer to tag the Title Suit No. 165 of 2018 along with Eviction Suit No. 72 of 2018 pending before the learned Sub Judge-IX, Patna since both civil cases are being contested by the same parties in which common issues are involved and simultaneous trials of both the civil cases are necessary for its expeditious disposal.

03. After some argument, learned counsel for the petitioner confines his prayer to issuance of direction for expeditious disposal of Title Suit No. 165 of 2018.

Learned senior counsel appearing on behalf of respondent no. 1 submits that the issues are not common as one suit has been filed for eviction whereas the other suit is for specific performance of contract. However, he has no objection to the prayer made by the learned counsel for the petitioner.
05. Since, the petitioner confines his prayer for early disposal of Title Suit No. 165 of 2018 within a stipulated time period, I think no useful purpose would be served in issuing notice to the other respondents.
06. In the light of limited prayer of learned counsel for the petitioner, the court concerned is directed to dispose of Title Suit No. 165 of 2018 preferably within nine months from the date of receipt/production of a copy of this order. The parties are directed to co-operate with the proceeding before the learned trial court.
07. Accordingly, the present petition stands disposed of with the aforesaid observation.
