2. The petitioner seeks bail in connection with a case registered for the offence punishable under Sections 126(2)/ 115(2)/118(1)/109/74/3(5)/103(2) of the BNS. Later on, Section 103(2) of the BNS was added.

3. As per the prosecution case, on 09.11.2024 at 07:00 p.m., the informant along with his cousin sister were on the way to their home, suddenly, some boys came up and started misbehaving with cousin sister of the informant. It is further alleged that they also assaulted some of the villagers with knife. It is further alleged that all the accused persons also assaulted Vishram Singh, Rajesh Prasad, Mukesh Prasad, Jay Ram Singh and Ranjan Kumar Kushwaha with knife and stone on their

Patna High Court CR. MISC. No.15719 of 2025(5) dt.11-07-2025 2/2 head. As a result, one of the injured Vishram Singh died during the course of treatment.

4. Learned counsel for the petitioner submits the petitioner has been falsely been implicated in this case. The parties are co-villagers. He further submits that during the course of investigation, one protest petition was filed by the informant in which the informant alleged that it was co-accused Manish Kumar who assaulted the deceased with Bricks as a result of which the deceased sustained two injuries on his head. The petitioner is in jail since 11.11.2024 and he claims antecedent.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

Considering the facts and circumstances of the case and the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj/ concerned court in connection with Gopalganj Town P.S. Case No. 802/2024.
