JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-11-2022 The short prayer made by the petitioner in the present writ petition is to dispose off the pending Encroachment case no. 02 of 2022-23, initiated by the Circle Officer, Kurtha, Arwal, Bihar.

The learned counsel for the petitioner has submitted that the petitioner had approached the Public Grievance Redressal Officer, Arwal, whereafter the Circle Officer, Kurtha, Arwal, Bihar i.e. respondent no. 4 had filed his reply stating therein that the aforesaid encroachment case has been initiated for removal of private tank constructed over the public land pertaining to Plot no. 784 and 793, Khata no. 76, Thana no. 155

Patna High Court CWJC No.4515 of 2022(2) dt.28-11-2022 2/2 in the village-Narhi.

Having regard to the limited prayer made by the petitioner, I deem it fit and appropriate to dispose off the present writ petition with a direction to the respondent no. 4 to dispose off the aforesaid Encroachment case no. 02 of 2022-23, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, in accordance with law and after hearing the affected parties, within a period of 12 weeks of receipt/ production of a copy of this order.
