2. The petitioner has preferred this application for grant of regular bail in connection with Muffasil P.S. Case No. 71 of 2025 dated 11.03.2025 registered for the offences punishable under Sections 126(2), 115(2), 352, 109 and 3(5) of B.N.S.

3. As per the prosecution case, the petitioner is alleged to have assaulted on head of the son of the informant by means of iron rod, while petitioner along with others also assaulted the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that there is a delay of about 13 days in lodging the FIR. The petitioner happens to be maternal uncle of the injured Md. Sadab and, in fact, the petitioner in good faith

No.14301 of 2026(2) dt.12-03-2026 2/2 had advised not to smoke a cigarette which resultant into aggression by the son of the informant and he received injuries after hitting on the wall. There was no complaint by either side but subsequently after 13 days, in order to blackmail and to put pressure, the present case has been lodged. As per the allegation, there is no repetition of blow against the petitioner. The chargesheet has been submitted against the petitioner and there is no allegation of tampering. The petitioner is an accused in one case in which he is on bail. The petitioner is in custody in this case since 01.12.2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Munger in connection with Muffasil P.S. Case No. 71 of 2025.

7. The application stands allowed.
