====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-06-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 419, 420, 467, 468, 371, 120(B)/34 of the Indian Penal Code.

It is alleged that this petitioner along with other accused persons, under conspiracy, got executed the sale deed in favour of the informant of the land which belonged to Md. Islam by one Md. Shahnawaj.

Learned counsel for the petitioner submits that from perusal of the F.I.R. it is apparent that co-accused Md. Shahnawaj executed the said sale deed. He is only alleged to be the mediator and as per allegation, husband of the informant

Patna High Court CR. MISC. No.14671 of 2023(3) dt.27-06-2023 2/2 has withdrawn the amount from self cheque and handed over the cash in presence of one Mukesh Gupta. Petitioner is neither the owner of the land in question, nor did he sell the land, nor is he the eye-witness of the said sale deed. It is further submitted that no chit of paper has been filed in support of the allegation against the petitioner. Petitioner has got clean antecedent. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Samastipur in connection with Samastipur (M) P. S. Case No. 374 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
