Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 18.9.2017 passed in Cr. Misc. No.42376 of 2017 and there is recovery of one country made pistol and one cartridge as well as the petitioner has criminal antecedent also.
Submission of the learned counsel for the petitioner is that the petitioner was directed to renew his prayer for bail after six months if the trial court is not concluded and six months' period has already expired and the trial has not been concluded. Up-till-now not a single witness has been examined. The petitioner is in custody for more than one year. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.25301 of 2018 (2) dt.25-04-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Ist, Samastipur in connection with Tajpur P.S.Case no.82 of 2017, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.
With the aforesaid observation, this application is allowed.
