JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-04-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Sanokhar (Amdanda) Police Station Case No. 126 of 2015, disclosing offences under Sections 147, 149, 341, 323, 307, 504, 506, 302 of the Indian Penal Code. The father of the informant is the deceased. The allegation against these petitioners and other co-accused persons are that they assaulted the informant with lathi. Allegedly, when his family members came in his rescue, coaccused Janardan Pandit hit the informant's father and mother on their heads. The father of the informant subsequently died after two days of occurrence. Learned Counsel appearing on behalf of the petitioners has submitted that there is no allegation against

Patna High Court Cr.Misc. No.14593 of 2016 (2) dt.21-04-2016 2/2 these petitioners of assaulting the deceased. Considering the fact that the petitioners are ladies and there is no allegation against them of assaulting the deceased, this application is allowed.

Let the petitioners, namely, Hina Devi and Mungia Devi, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Bhagalpur, in connection with Sanokhar (Amdanda) Police Station Case No. 126 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
