JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 The petitioner seeks regular bail in connection with Barachatti P.S. Case No. 478 of 2018, registered for offences punishable under Sections 302, 201, 328, 120(B)/34 of the Indian Penal Code.

Allegation as per F.I.R. is that the deceased was traceless for five to six days, thereafter a Panchayati was held, in which, the petitioner, who is wife of the deceased, has confessed her guilt to have administered poison to her husband causing her death and concealing the dead body into a ditch and, thereafter, the dead body of the deceased was recovered from a ditch and it is further alleged that petitioner has love affair with one Rajendra Yadav.

It has been submitted on behalf of the petitioner that there is delay of seven days in lodging the F.I.R. and the dead

Patna High Court CR. MISC. No.17662 of 2019(3) dt.20-05-2019 2/2 body of the deceased was recovered outside the house. Further submission is that she has falsely been made accused in this case and has been languishing in judicial custody for about ten months.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail.

However, since the petitioner has been in judicial custody for about ten months, learned court below is directed to expedite the process of commitment of the case and, thereafter, expedite the trial also.

With the above observation, this application is dismissed.
