Smt. Nirmala Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 26-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Civil Lines P.S.Case No. 175 of 1981 registered under Sections 25 (A) and 26 of the Arms Act. It's a case of misuse of bail by the petitioner as jumped bail in the year 2013 and now the petitioner is in custody for last six month's approximately and it's a case under Sections 25 (A) and 26 of the Arms Act.

Learned counsel for the petitioner submits that it's a case of the year 1981 and trial was not concluded for a long period and the petitioner is a labourer and for the misuse of bail he had already remained in custody for six month's approximately. Having considered the aforesaid facts and circumstances, the petitioner, namely, Mahendra Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with

Patna High Court Cr.Misc. No.43427 of 2018(3) dt.26-07-2018 2/2 two sureties of the like amount each to the satisfaction of the learned Additional District Sessions Judge Fast Track Court-1, Gaya in connection with Civil LInes P.S. Case No. 175 of 1981, with condition that petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
