JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-03-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Muffasil P.S. Case No. 430 of 2018, G.R. No. 3612/2018 for the offenses under Sections 147, 148, 149, 341, 323, 307 of the Indian Penal Codeand Section 27 of the Arms Act. Learned counsel for the petitioner submits that for the same occurrence a counter case was registered. Referring to the prosecution case he submits that allegation against the petitioner is that he has fired which caused injury to Ashish Kumar. The injury is simple in nature.

Considering the fact that the petitioner has no criminal antecedent and the petitioner is in custody since 8.12.2018, the

Case No. 430 of 2018, G.R. No. 3612/2018.
