Deceased Deepak Kumar @ Laddoo and his cousin brother Manish Kumar were in a way to Lerha Bahiyar for irrigational wok in the night of 8.9.2019, he received a call from Parwati Kumari, daughter of Vijay Mandal, co-villager, whereupon they both gone to the house of Vijay Mandal and then deceased climbed over the roof from behind while Manish returned back. Due to non-returning of the deceased, the family members began to search and during course thereof, his dead body was found on 10.9.2019 in a bush lying at the bank of Kuwa river. It has also been disclosed that for the last 7-8 months there was love affair going on in between the deceased and Parwati.

None had seen save and except Manish climbing over the roof of Vijay Mandal from the back side of the house by the deceased. The dead body of the deceased was not found from the house of the petitioner. In the aforesaid facts and circumstances of the case, the petitioner being an elderly lady, being under custody since 11.9.2019 deserves bail.

Consequent thereupon, the petitioner Putul Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Bhagalpur in Kahalgaon P.S.Case No. 612/2019.
