The petitioner seeks bail in anticipation of his arrest in connection with Koch P.S. Case No. 140 of 2018 dated 06.05.2018 instituted for the offences under Sections 341, 323, 324, 325, 307, 354, 379, 427, 504, 506 and 34 of the Indian Penal Code.

Though the petitioner is also said to have indulged in assault but from the averments made in the FIR, it becomes very clear that the dispute arose because of some claim over the drainage between the houses of the parties. There is a counter version of the occurrence as well lodged by one Sundari Devi. No specific act of assault has been attributed to the petitioner.

No.15558 of 2019(2) dt.15-03-2019 2/2 Considering this aspect of the matter and taking into account his clean antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Gaya in connection with Koch P.S. Case No. 140 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
