The petitioner seeks bail in anticipation of his arrest in connection with Warisnagar P. S. Case No. 249 of 2018 dated 02.09.2018 instituted for the offences under Section 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

9 litres of liquor is said to have recovered from the possession of one Sushil Kumar Rai, who was, at the time of search, riding a motor-cycle belonging to the petitioner hence, the prosecution of the petitioner as well in the present case.

No.14800 of 2019(2) dt.13-03-2019 2/2 Mr. Prabhat Kumar Singh, learned advocate for the petitioner, has submitted that the petitioner who is a mason by profession, had given his motor-cycle to his friend, Sushil Kumar Rai, who may have carried liquor in that motor-cycle, but the aforesaid fact was not known to the petitioner. Regard being had to the nature of accusation and taking into account his clean antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-3 cum Special Judge, Excise Act, Samastipur, District - Samastipur in connection with Warisnagar P. S. Case No. 249 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
