2. The petitioner has moved the Court for his pensionary benefits to be fixed in terms of his promotion given with effect from 01.11.2011 issued on 21.10.2014.

3. The matter was hanging for sometime but in view of the affidavit filed on behalf of respondent no. 3, where it has been stated that the said promotion having been confirmed, the matter shall be referred to the District Accounts Officer, Nawada for

Patna High Court CWJC No.6525 of 2016 dt.19-01-2018 2/2 approval of the pay fixed for the petitioner and upon the same being done, it shall be sent to the Accountant General for necessary action.

4. In view thereof, the Court finds that the writ petition has served its purpose. Accordingly, the same stands disposed off with a direction to the respondent no. 3 to ensure that the matter is referred to the District Accounts Officer, Nawada expeditiously and latest within a period of two weeks from the date of production of a copy of this order before the respondent no. 3. Upon the same being done, the District Accounts Officer shall take appropriate action in the matter and shall then send it back to the respondent no. 3 within two weeks of him receiving the same from respondent no. 3. The respondent no. 3 shall thereafter ensure that within two weeks sanction is sent to the Accountant General, who in turn, will issue authority within two weeks from the date of receiving such sanction order in favour of the petitioner.

5. Learned counsel for the respondents shall ensure compliance.
