15-09-2017 Heard Sri Sanjay Kumar, learned counsel for the petitioner and Sri Lakshmi Kant Sharma, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 18-06-2017 in Barahara (Krishnagarh) P.S. Case No. 175 of 2017 registered for offence under Section 414 of the Indian Penal Code and Sections 30(A) & 56(D) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that petitioner has falsely been made accused on an accusation as if petitioner was escorting a 4-wheeler, from which, about 192 liter of Indian make foreign liquor was recovered. Learned counsel for the petitioner submits that besides the present case, the petitioner was never involved in the case relating to Excise
Patna High Court Cr.Misc. No.41667 of 2017(2) dt.15-09-2017 2/2 Act, however; earlier he was made accused in a case registered for offence under Section 498(A) of the Indian Penal Code. Learned Addl. Public Prosecutor has opposed the prayer.
However, considering the nature of accusation and period of custody, let the petitioner namely Niraj Kumar Singh @ Niraj Singh @ Bhim Singh be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - IV (Excise Act), Bhojpur at Ara in connection with Barahara (Krishnagarh) P.S.
