The petitioners seek bail in connection with Ekangar Sarai P.S. Case No. 16 of 2018 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 159 liters of foreign liquor and country made liquor and motorcycle are said to have been recovered from the mustard field of Bhola Prasad and four accused persons, including the petitioners managed to escape from the aforesaid place.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.26726 of 2018(2) dt.03-05-2018 2/2 petitioners that no incriminating article has been recovered from the conscious possession of the petitioners. They have no concern either with the seized liquor or the place of recovery or the motorcycle in question. They have been falsely implicated in the case at the instance of their enemies. They have no criminal antecedent. They have been languishing in custody since 08.04.2018.
Considering the facts, aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Ekangar Sarai P.S. Case No. 16 of 2018 to the satisfaction of the Special Judge, Excise Act, Nalanda at Biharsharif.
