The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 427, 504, 506, 307 and 302 of the Indian Penal Code. It is a case of assault upon Md. Saleem @ Fuddu by means of iron rod and pipe and cricket bat by co-accused Mukesh Kumar @ Saroj and Manoj Kumar due to which Md. Saleem @ Fuddu died.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the main allegation is against co-accused Mukesh Kumar @ Saroj and Manoj Kumar and not this

From perusal of the case diary, it appears that no postmortem report is annexed with the case diary. In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Kazimohammadpur P.S. Case No. 166 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
