The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 290, 341, 323, 332, 353, 354, 427 and 504 of the Indian Penal Code. Allegedly, after some altercation, the accused persons named in the FIR including this petitioner have blocked the National Highway and were damaging the government property, and when the informant along with police force reached there, all the accused persons started assaulting them. They also created hindrance in performing the official duty of the informant and police officials. They were molesting the female passengers at the place of occurrence.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely
Patna High Court CR. MISC. No.16870 of 2023(3) dt.06-07-2023 2/2 implicated in this case due to ulterior motive. Petitioner was not present at place of occurrernce. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Similarly situated co-accused, namely, Alok Kumar has been enlarged on bail by this court vide order dated 13.12.2022 passed in Cr. Misc. No. 53401 of 2022. Petitioner has no criminal antecedent as mentioned in para-3 of this application.
Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, as there is no specific overt act against the petitioner, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Sugauli P.S. Case No. 222 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Anjani Kumar Sharan, J) divyanshi/- U T
