JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 15.04.2015 and earlier his prayer for bail was rejected on the ground that he was caught with stolen motorcycle.

However, while rejecting the prayer for bail of the petitioner, this Court directed the trail court to expedite the trail of the petitioner but the trial court has reported that during pendency of the trail of the petitioner, the petitioner was sent Supaul jail in connection with Jadiya P.S.Case No. 124 of 2014 and 155 of 2014 and in spite of several directions, the petitioner was not produced before him, as a result whereof, not a single prosecution witness

Patna High Court Cr.Misc. No.37294 of 2017 (3) dt.06-09-2017 2/2 could be examined.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Araria in connection with Raniganj P.S. Case No. 80 of 2014, G.R.No. 1257 of 2014.
